Банк России планирует ввести в действие стандартные минимальные требования к условиям и порядку осуществления отдельных видов добровольного страхования в части предоставления информации об условиях добровольного страхования. То есть страховщики (их представители) до заключения договора страхования будут обязаны предоставить потребителю основные параметры страхового продукта, кроме договоров о страховании жизни с условием периодических страховых выплат (ренты, аннуитетов) и (или) с участием страхователя в инвестиционном доходе страховщика. С соответствующим проектом1 указания можно ознакомиться на сайте регулятора. Ввести его в действие предлагается с 1 октября 2021 года – в отношении личного страхования и с 1 апреля 2022 года – по другим видам добровольного страхования.
В стандарт предоставления информации должны войти следующие сведения, подлежащие раскрытию:
наименование страховщика, его адрес (место нахождения), номер телефона и адрес электронной почты; электронный адрес страницы официального сайта страховщика, где размещены правила страхования, на основании которых составлен информационный документ, а также QR-код, содержащий ссылку для прямого доступа к указанной странице; не менее пяти страховых случаев, а если в соответствии с условиями добровольного страхования их число менее пяти – все страховые случаи, ссылка на пункты правил страхования, содержащие перечень страховых случаев; не менее пяти оснований отказа в признании события страховым случаем, оснований отказа в страховой выплате (выплате страховой суммы), а в случае, если их менее пяти – перечислить все основания, ссылка на пункты правил страхования, содержащие перечень оснований отказа в признании события страховым случаем; территория страхования; обязанности страхователя, выгодоприобретателя, застрахованного лица при увеличении страхового риска в период действия договора добровольного страхования, а также при наступлении страхового случая; порядок уплаты страховой премии, в случае если условиями добровольного страхования предусмотрено внесение страховой премии в рассрочку; порядок получения страховой выплаты; период страхования; случаи досрочного прекращения договора добровольного страхования, когда страховщиком возвращается страховая премия или ее часть, а также разъяснение, что в иных случаях досрочного отказа страхователя от договора добровольного страхования страховая премия или ее часть не возвращается; досудебный порядок урегулирования споров.

При использовании в данном документе отсылок к положениям законодательства РФ их содержание должно быть раскрыто, так же как и значение специальных терминов. Обращается внимание, что вся информация должна быть изложена шрифтом кегля не менее 11 пунктов, в виде таблицы, объемом не более двух страниц А4. Ознакомление получателя страховых услуг с данным документом он должен подтвердить подписью (электронной подписью).
Отмечается, что в случае нарушения страховщиком обязанности по раскрытию указанной информации страхователь сможет отказаться от договора страхования и получить назад уплаченную страховую премию. Соответствующие изменения подготовлены2 в указание Банка России от 20 ноября 2015 года № 3854-У «О минимальных (стандартных) требованиях к условиям и порядку осуществления отдельных видов добровольного страхования».
