В Госдуму внесен законопроект, направленный на запрет звуковой рекламы товаров и услуг на улицах населенных пунктов, а именно, с использованием громкоговорителей и других звукоусиливающих и звукопроизводящих устройств. Соответствующее дополнение планируется1 внести в ст. 5 Федерального закона от 13 марта 2006 года № 38-Ф3 «О рекламе» (далее – Закон № 38-ФЗ).

В пояснительной записке к законопроекту указывается, что в названном законе регламентирован только запрет на распространение звуковой рекламы и звуковое сопровождение рекламы с использованием транспортных средств (ч. 6 ст. 20 Закона № 38-ФЗ). Однако прямого запрета на звуковую рекламу товаров и услуг на улицах населенных пунктов не установлено. Между тем такая реклама, как считают авторы законопроекта, крайне негативно влияет на здоровье и качество жизни россиян, поскольку даже при условии соблюдения санитарных норм по уровню шума не обеспечивает для человека благоприятную среду обитания.
