Правительство РФ внесло в Госдуму законопроект, предусматривающие поправки в налоговое законодательство в части введения механизма налогового вычета в отношении налога на прибыль, налога на имущество организаций, транспортного и земельного налогов, уплачиваемых участником соглашения о защите и поощрении капиталовложений для возмещения понесенных затрат при реализации инвестпроекта1. Предполагается, что поправки вступят в силу с 1 января 2022 года.
Так, согласно законопроекту, при применении налогового вычета вышеуказанные налоги, сформированные от деятельности в рамках реализации инвестпроекта, по итогам налогового периода могут быть снижены до нуля. В отношении земельного налога предлагается установить ограничение – вычет можно будет применить, только если стороной соглашения о защите и поощрении капиталовложений будет также являться муниципальное образование. Что касается суммы примененного налогового вычета, то она, в совокупности с объемом господдержки (субсидий), не должна будет превышать сумму понесенных затрат. Предельный объем вычетов должен будет указываться в специальном уведомлении, которое направляется в ФНС России уполномоченным федеральным органом исполнительной власти для начала применения налоговых вычетов налогоплательщиками.

Также планируется прописать, что возможность применения налогового вычета не будет зависеть от отдельных решений органов госвласти субъектов РФ, а предельный срок применения налогового вычета не должен превышать предельные сроки, установленные Федеральным законом от 1 апреля 2020 г. № 69-ФЗ для отдельных видов затрат. Для того, чтобы получить такой вычет, налогоплательщику необходимо будет обеспечить ведение раздельного учета.
