Действующее законодательство в числе случаев признания заявки на участие в открытом конкурсе в электронной форме не соответствующей требованиям, установленным конкурсной документацией, указывает случаи наличия недостоверных сведений в документах и информации, предусмотренных ч. 11 ст. 24.1, ч. 4 и ч. 6 ст. 54.4 Федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее – Закон № 44-ФЗ) (п. 2 ч. 4 ст. 54.7 Закона № 44-ФЗ). Речь идет о недостоверных данных на дату и время рассмотрения вторых частей заявок на участие в такой закупке.
ФАС России отмечает, что конкурсная комиссия проверяет заявки на участие в конкурсе на соответствие требованиям, предъявляемым закупочной документацией. Она самостоятельно принимает решение о соответствии конкретной заявки:
нормам закона; документации о закупке; извещению о проведении конкурса на основании имеющихся сведений.
В связи с этим при обнаружении комиссией в документах заявки недостоверной информации, в том числе в документах, предоставленных для оценки, она должна отклонить заявку такого участника закупки. Подчеркивается, что в обязанности членов комиссии не входит проверка достоверности сведений, представленных участником в составе его заявки. Исключение предусмотрено для случаев, указанных в ст. 31 Закона № 44-ФЗ.
