Правительством РФ накануне вынесены решения о предоставлении возможности дочерним обществам системообразующих компаний получить кредит по льготной ставке, когда часть кредита субсидируется государством (Распоряжение Правительства РФ от 20 мая 2020 г. № 1349-р и Постановление Правительства РФ от 20 мая 2020 г. № 712).
Кроме того, уточняются критерии выдачи таких займов путем внесения изменений в Правила предоставления субсидий из федерального бюджета российским кредитным организациям на возмещение недополученных ими доходов по кредитам, выданным в 2020 году системообразующим организациям на пополнение оборотных средств, утв. Постановлением Правительства РФ от 24 апреля 2020 г. № 582.
В частности, общий размер кредита для системообразующей организации и (или) ее дочерних обществ, не включенных в перечень (перечни) системообразующих организаций, не может превышать 3 млрд. руб., ставка по нему – 5% годовых. Период субсидирования равен 12 месяцам со дня заключения кредитного договора. При этом для дочернего общества необходимо наличие согласия системообразующей организации на получение указанного кредита.

Получение кредита исключается заемщиком, являющимся иностранным юрлицом, или с долей участия иностранных юрлиц в совокупности более 50%. Также юрлицо должно сохранить в течение периода субсидирования численность работников в размере не менее 90% работников по состоянию на 1 мая 2020 года. Это должно подтверждаться письмом заемщика в свободной форме об отчислениях в ПФР, ежемесячно направляемым в адрес кредитной организации не позднее 1-го рабочего дня месяца, следующего за отчетным месяцем, а также информацией по форме, утвержденной ПФР, ежемесячно направляемой в адрес кредитной организации не позднее 15-го числа месяца, следующего за отчетным месяцем.
Предъявляется требование о сокращении выручки заемщика от продажи товаров, продукции, работ, услуг за период с 1 апреля по 30 июня 2020 г. не менее чем на 30% по сравнению с таким показателем за аналогичный период прошлого года.
Помимо этого, кредитный договор должен содержать условие о запрете на объявление и выплату дивидендов заемщиком в течение периода субсидирования, за исключением случаев, предусмотренных отдельными решениями Правительства РФ.
Постановление Правительства РФ от 20 мая 2020 г. № 712 вступает в силу с сегодняшнего дня, а Распоряжение Правительства РФ от 20 мая 2020 г. № 1349-р – 30 мая.
