В связи с этим, Росфинмониторнг в настоящее время не проводит проверки соблюдения требований законодательства о противодействии легализации (отмыванию) доходов, полученных преступным путем, финансированию терроризма, за исключением отдельных случаев.
Как сообщает Федеральная служба, такое решение в условиях неблагоприятной эпидемиологической обстановки и в последующий период снижает общую административную нагрузку на субъекты хозяйственной деятельности (информационное сообщение Федеральной службы по финансовому мониторингу от 21 мая 2020 г.). Тем не менее это не отменяет обязанности поднадзорных субъектов соблюдать требования «антиотмывочного» законодательства.
Поэтому Росфинмониторинг в условиях отсутствия проверок продолжит осуществлять дистанционный мониторинг деятельности поднадзорных организаций на предмет соблюдения обязательных требований законодательства о противодействию отмыванию доходов и финансированию терриризма. Также будет доводиться информацию о рисках незаконопослушности с использованием возможностей Личного кабинета.

После же окончания периода действия ограничений на проведение проверок государственный контроль будет осуществляться в обычном режиме. Проверке, в том числе, будет подлежать соблюдение поднадзорными организациями обязательных требований в течение 2020 года. Но при осуществлении мероприятий контроля будут учитываться последствия воздействия неблагоприятных факторов, обусловленных эпидемиологической обстановкой, изменением характера и условий работы.
Что касается административных мер, то применяться они будут при допущении поднадзорными субъектами грубых нарушений, к которым планируется относить непредставление и несвоевременное представление сведений об операциях.
