В Госдуму поступил правительственный законопроект, направленный на усиление административной ответственности в части нарушения ветеринарного законодательства. Так, предлагается1 установить ответственность за повторное совершение правонарушений, предусмотренных ч. 1 – ч. 2 ст. 10.6 КоАП РФ. В частности, за повторное нарушение правил карантина животных или других ветеринарно-санитарных правил штраф может составить:
для граждан в размере от 3 тыс. до 5 тыс. руб. (сегодня штраф составляет от 500 до 1 тыс. руб.); должностных лиц – от 15 тыс. до 30 тыс. руб. (действующая санкция – от 3 тыс. до 5 тыс. руб.); ИП – от 15 тыс. до 30 тыс. руб. или административное приостановление деятельности на срок до 30 суток (сегодня от 3 тыс. до 5 тыс. руб или приостановление деятельности до 90 суток); юрлиц – от 50 до 150 тыс. руб. или административное приостановление деятельности до 30 суток (сегодня от 10 тыс. до 20 тыс. или приостановление деятельности до 90 суток).
Повторное нарушение правил борьбы с карантинными и особо опасными болезнями животных также может повлечь увеличенные штрафы, например, для ИП – от 30 тыс. до 50 тыс. руб. или административное приостановление деятельности на срок до 30 суток, для юрлиц – от 150 тыс. до 300 тыс. руб. или административное приостановление деятельности на срок до 30 суток.

На случай если нарушение правил борьбы с карантинными и особо опасными болезнями животных повлечет за собой возникновение очагов заразных болезней животных и (или) распространение таких болезней планируется установить ответственность, дополнив ст. 10.6 КоАП РФ частью 3. Наказание за совершение такого правонарушения также предусмотрено в виде штрафа или административного приостановления деятельности, при этом штраф для ИП максимально может быть установлен в размере 70 тыс. руб., для юрлиц – 500 тыс. руб. За сокрытие сведений о внезапном падеже или об одновременных массовых заболеваниях животных (ст. 10.7 КоАП РФ) также предлагается увеличить размеры действующих штрафных санкций. Кроме того, предусматривается внесение корреспондирующих изменений в ст. 3.5 КоАП РФ.
Авторы законопроекта в пояснительной записке отмечают, что согласно статистическим данным можно сделать вывод, что действующие меры наказания не способствуют профилактике и предупреждению правонарушений в области ветеринарного законодательства и не стимулирует граждан, организации и индивидуальных предпринимателей к соблюдению его норм.
