Каждый из супругов имеет право на имущественный налоговый вычет в отношении имущества, находящегося в общей совместной собственности. Рассчитываться он будет исходя из подтвержденных платежными документами расходов каждого супруга, или на основании их заявления о распределении расходов на приобретение недвижимости. При этом предельный объем вычета а каждого составит не более 2 млн руб.
После предоставления вычета, как поясняет налоговая служба, перераспределить его или переносимый на последующие налоговые периоды остаток по заявлению налогоплательщиков уже не получится, поскольку законодательством не предусмотрена возможность отказа гражданина от уже предоставленного налогового вычета (письмо ФНС России от 4 октября 2021 г. № БС-3-11/6615@).
Именно поэтому после того, как одному из супругов полностью был возвращен НДФЛ в рамках вычета по расходам на приобретение объекта недвижимости, находящейся в общей совместной собственности, другому супругу в получении такого налогового вычета в размере фактически произведенных расходов на приобретение этого имущества будет отказано.
Вместе с тем второй супруг может получить вычет в сумме фактически произведенных расходов на погашение процентов по целевым займам (кредитам), фактически израсходованным на новое строительство либо приобретение на территории России, в том числе, жилого дома, квартиры, комнаты или доли (долей) в них (п. 1 ст. 220 Налогового кодекса). Его размер составляет не более 3 млн руб. Для этого нужно предоставить подтверждающие расходы документы, такие как договор займа (кредита), а также платежные документы, подтверждающие факт уплаты денежных средств в погашение процентов.

Такой вычет предоставляется каждому из супругов исходя из величины расходов каждого лица, подтвержденных платежными документами, или на основании заявления супругов о распределении их расходов на погашение процентов по целевому займу (кредиту). Заявление может предоставляться каждый раз при подаче налоговой декларации по форме 3-НДФЛ с указанием различных процентных соотношений в отношении расходов по уплате процентов при приобретении имущества, понесенных в конкретном году.
