С 1 января 2022 года начнет действовать скорректированный порядок выплаты обеспечения по ОСС – пособий по временной нетрудоспособности, в том числе в связи с несчастным случаем на производстве или профзаболеванием, по беременности и родам, ежемесячного пособия по уходу за ребенком, единовременного пособия женщинам, вставшим на учет в медорганизациях в ранние сроки беременности, единовременного пособия при рождении ребенка (Федеральный закон от 30 апреля 2021 г. № 126-ФЗ).
Внесение поправок обусловлено обеспечением перехода от «зачетного» принципа расходования средств ФСС России (сумма страховых взносов на ОСС на случай временной нетрудоспособности и в связи с материнством уменьшается на сумму произведенных расходов на выплату страхового обеспечения по указанному виду соцстрахования) к механизму выплаты страхового обеспечения застрахованному лицу непосредственно территориальными органами Фонда. Такой порядок предполагает, что страхователь уплачивает страховые взносы в ФСС России в полном объеме. В некоторых регионах в настоящее время уже проводится пилотный проект «Прямые выплаты», реализация которого признана успешной.

Так, в частности, законом устанавливаются новые правила выдачи и оплаты листка нетрудоспособности. С 2022 года в большинстве случаев он будет выдаваться в форме электронного документа. Также корректируются и процедуры назначения и выплаты вышеуказанных пособий и устанавливается новый порядок проведения проверок полноты и достоверности сведений и документов, представляемых страхователем для назначения и выплаты этих пособий.
