Президент РФ подписал закон, вносящий поправки в налоговое законодательство в части закрепления отдельных мер поддержки пострадавшим организациям и предпринимателям (Федеральный закон от 8 июня 2020 г. № 172-ФЗ). Закон вступает в силу со дня его официального опубликования (с 8 июня 2020 года) и его положения распространяются на правоотношения, возникшие с 1 апреля 2020 года.
Документ предусматривается освобождение от уплаты налогов за II квартал 2020 года следующих категории налогоплательщиков:
предпринимателей, работающих в отраслях экономики, в наибольшей степени пострадавших из-за распространения новой коронавирусной инфекции; организации, которые включены на основании налоговой отчетности за 2018 год в единый реестр субъектов МСП, а также работают в отраслях экономики, в наибольшей степени пострадавших из-за распространения новой коронавирусной инфекции; юрлица, включенные в реестр социально ориентированных некоммерческих организаций, которые с 2017 года являются получателями грантов Президента РФ, субсидий и грантов в рамках специальных программ. Их реализуют федеральные органы исполнительной власти, органы исполнительной власти субъектов РФ, органы местного самоуправления, исполнители общественно полезных услуг, поставщики социальных услуг; централизованные религиозные организации, учрежденные ими социально ориентированные некоммерческие организации, а также религиозные организации, входящие в структуру централизованных религиозных организаций; некоммерческие юрлица, включенные в реестр некоммерческих организаций, в наибольшей степени пострадавших из-за распространения новой коронавирусной инфекции.

Вышеуказанные налогоплательщики смогут воспользоваться предоставленной льготой при на период владения объектами налогообложения с 1 апреля по 30 июня 2020 года. В зависимости от вида налога устанавливается и льготный объект налогообложения. Так, например, льгота по транспортному налогу будет применяться в отношении транспортных средств, используемых (предназначенных для использования) в предпринимательской или уставной деятельности. Аналогичное правило применяется и для земельного налога. В отношении налога на имущество организаций освобождение будет действовать для всех объектов, а по налогу на имущество физлиц – для объектов недвижимости, используемых (предназначенных для использования) в предпринимательской деятельности.
Также вышеуказанные налогоплательщики освобождаются от уплаты:
по налогу на прибыль организаций — в части ежемесячных авансовых платежей, подлежащих уплате во II квартале 2020 года; авансовых платежей, подлежащих уплате в бюджет за отчетные периоды четыре, пять, шесть месяцев 2020 года, за минусом ранее начисленных сумм за отчетный период три месяца; авансовых платежей, подлежащих уплате в бюджет за полугодие 2020 года, за минусом ранее начисленных сумм авансовых платежей за I квартал; по акцизам — в части налога за налоговые периоды апрель, май, июнь 2020 года; по водному налогу — в части налога за налоговый период II квартал 2020 года; по НДПИ — в части налога за налоговые периоды апрель, май, июнь 2020 года; по ЕСХН — в части авансового платежа за отчетный период полугодие 2020 года. Он засчитывается в счет уплаты налога по итогам налогового периода 2020 года; по УСН — в части авансового платежа за отчетный период полугодие 2020 года, уменьшенного на сумму авансового платежа за отчетный период I квартал 2020 года; по ЕНВД — в части налога за II квартал 2020 года; по НДФЛ, исчисляемому и уплачиваемому предпринимателями, — в части авансового платежа, исчисленного за полугодие 2020 года, уменьшенного на сумму авансового платежа, исчисленного за I квартал 2020 года; по торговому сбору — в части сбора, исчисленного за II квартал 2020 года.
Для тех же предпринимателей, которые работают по патенту, предусмотрен перерасчет суммы налога, подлежащей уплате в 2020 году, исключающий календарные дни, приходящиеся на апрель, май и июнь 2020 года из количества дней срока, на который выдается патент.
