В Госдуму поступил соответствующий законопроект о внесении дополнения в ч. 2.1 ст. 7 Федерального закона от 27 июня 2011 г. № 161-ФЗ «О национальной платежной системе» (далее – Закон № 161-ФЗ), которым предлагается1 прописать исключение из нормы о запрете на пополнение наличными денежными средствами любых неперсонифицированных электронных средств платежа. Такой запрет планируется не распространять на случаи, когда в соответствии с договором, заключенным с оператором электронных денежных средств, клиент – физлицо может выступать плательщиком исключительно в целях оплаты услуг, которые оказываются юрлицом или ИП, по перевозке пассажиров и багажа и (или) услуг по организации школьного питания, и (или) услуг дополнительного образования.
Напомним, Банк России разрешил до 1 апреля 2021 года кредитным организациям осуществлять пополнение электронных транспортных карт наличными, о чем портал ГАРАНТ.РУ писал ранее. В этой связи санкции к банкам за нарушение ч. 2.1 ст. 7 Закона № 161-ФЗ в связи с осуществлением операций пополнения наличными деньгами транспортных и школьных карт оплаты до указанного срока применяться не будут.

Как следует из пояснительной записки к законопроекту, предлагаемые меры направлены на необходимость сохранить положительный опыт работы ряда транспортных и школьных карт, поскольку как показывает практика, с их помощью население активно переходит к безналичному обороту. «Сохранение возможности пополнения таких карт наличными денежными средствами позволит получать гражданам удобные платежные сервисы, повысит прозрачность денежного обращения, а также снизит финансовую нагрузку на бюджеты ряда субъектов Российской Федерации», – считают авторы инициативы.
