В Госдуму внесен законопроект, предлагающий ряд поправок в налоговое законодательство, устанавливающих принципиально иной подход к налоговому режиму экспорта сырьевых товаров, предусматривающий невозможность возмещения налога на добавленную стоимость при их реализации1. В случае принятия соответствующего закона, новые правила начнут применяться с 1 января 2021 года.
Так, предлагается установить гибкий подход к возмещению НДС в отношении лиц, осуществляющих экспорт сырья, установив, в частности, что Правительство РФ может определить ставку налога сырьевых групп товаров от 0 до 20 процентов в зависимости от степени переработки и вида вывозимого товара. Как указывается в пояснительной записке к законопроекту, такие правила будут распространяться на сырьевые товары, к которым относятся, в частности, минеральные продукты, продукты неорганической химии, соединения неорганические или органические драгметаллов, органические химические соединения, удобрения, необработанные шкуры (кроме натурального меха) и выделанная кожа, натуральный и искусственный мех, древесина , древесный уголь, пробка, жемчуг природный или культивированный, драгоценные или полудрагоценные камни, драгметаллы, никель, алюминий, свинец, цинк, олово, медь, черные металлы, иные недрагоценные металлы.

Законодатель полагает, что действующие в настоящий момент налоговые льготы по НДС являются неоправданными, поскольку возмещение налога призвано стимулировать экспорт высокотехнологичной продукции, а не сырья. Проект же направлен на установление более справедливого налогового регулирования, направленного на максимальное привлечение дополнительных доходов, направляемых в федеральный бюджет от богатств, которые должны работать в интересах России.
