В Госдуму был внесен законопроект, предусматривающий поправки в налоговое законодательство в части продление возможности применять ЕНВД1. Предполагается, что соответствующий закон вступит в силу с 1 января 2021 года.
Законопроектом предусматривается в целях обеспечения выполнения целевых показателей национального проекта «Малое и среднее предпринимательство и поддержка индивидуальной предпринимательской инициативы», оказания государственной поддержки субъектов малого предпринимательства для преодоления последствий экономического кризиса на фоне распространения новой коронавирусной инфекции в 2020 году продлить срок действия ЕНВД до 1 января 2024 года.
Законодатель полагает, что отмена ЕНВД окажет негативное влияние как на развитие экономики, так и на состояние бюджетов субъектов РФ, будет препятствовать выполнению показателей вышеуказанного национального проекта. Также в пояснительной записке к законопроекту отмечается, что для малого предпринимательства в нынешних экономических условиях отмена ЕНВД повлечет за собой не только увеличение затрат бизнеса на ведение бухгалтерского и налогового учета, к значительному снижению рентабельности, к сокращению персонала, но и к банкротству большого числа предприятий тех сфер деятельности, которые особенно пострадали из-за пандемии коронавируса и карантинных мер: общественное питание, индустрия красоты, бытовые услуги, мелко-розничная торговля, а также пассажирские и грузовые перевозки автомобильным автотранспортом.

Полноценной альтернативы ЕНВД на текущий момент нет. В качестве возможных спецрежимов налогообложения, заменяющих ЕНВД, предпринимательским сообществом практически единогласно обозначаются при условии их доработки УСН и наиболее близкая по механизму реализации ПСН. Но чтобы ПСН и УСН стали равноценной заменой ЕНВД необходимо полностью переработать критерии их применения. При этом, даже при условии оперативной доработки ПСН и УСН для безболезненного перехода на эти режимы потребуется переходный период. А продление ЕНВД, по мнению законодателя, позволит не только оказать реальную поддержку малому бизнесу в нынешних экономических условиях на фоне ухудшения ситуации в связи с распространением новой коронавирусной инфекции, но и сохранить занятость населения, стабильный источник налоговых доходов бюджетов муниципалитетов, обеспечить плавный безболезненный переход к альтернативным режимам налогообложения к 2024 году.
