В Госдуму поступил законопроект Правительства РФ, направленный на законодательное закрепление за самозанятыми гражданами права пользоваться мерами поддержки, реализуемыми в отношении субъектов МСП. Так, планируется1 дополнить Федеральный закон от 24 июля 2007 г. № 209-ФЗ «О развитии малого и среднего предпринимательства в Российской Федерации» ст. 14.1, в которой предусмотреть, что физлица, применяющие специальный налоговый режим (НПД) в рамках эксперимента, установленного Федеральным законом от 27 ноября 2018 г. № 422-ФЗ, вправе рассчитывать на финансовую, имущественную, информационную, консультационную и образовательную поддержку (в том числе в области сельскохозяйственной и ремесленной деятельности) со стороны корпорации развития МСП, федеральных, региональных и местных органов власти. Также предусматривается включение положений об оказании поддержки самозанятым посредством их участия в государственных, региональных и муниципальных программах, направленных на развитие МСП.

В Федеральный закон от 2 августа 2019 года № 279-ФЗ «О внесении изменений в Федеральный закон «О развитии малого и среднего предпринимательства в Российской Федерации» предполагаются изменения, касающиеся учета сведений о самозанятых лицах и субъектах МСП, получающих меры господдержки. Указанные сведения предлагается вносить в срок:
до 5 ноября 2020 года в отношении субъектов МСП, решения о предоставлении поддержки которым приняты за период с 1 января 2019 года по 1 октября 2020 года, и в отношении самозанятых лиц, решения о предоставлении поддержки которым приняты за период с 1 января 2020 года по 1 октября 2020 года; до 5 декабря 2020 года в отношении субъектов МСП и самозанятых лиц, решения о предоставлении поддержки которым приняты за период с 1 октября 2020 года по 1 декабря 2020 года.
Как полагают авторы инициативы, принятие закона создаст возможность для участия самозанятых граждан в госпрограммах, в программах АО «Корпорация «МСП» и его дочерних обществ, включая кредитно-гарантийную поддержку, участие в льготно-лизинговых программах, а также откроет доступ к сервисам портала Бизнес-навигатора МСП и к программам обучения.
