Так, предлагается1 принять Федеральный закон «Об обязательном страховании ответственности юридических лиц и физических лиц, осуществляющих предпринимательскую деятельность». В частности, планируется распределить уровень ответственности в зависимости от того, к какой группе предпринимателей относится субъект:
микробизнес (ИП, самозанятые);малый бизнес (ООО с денежным оборотом до 10 млн руб. в год);средний бизнес (ООО, ЗАО с денежным оборотом до 100 млн руб. в год);крупный бизнес (АО с денежным оборотом более 100 млн руб. в год).
Такая мера, по мнению автора идеи, с одной стороны, поддержит российский рынок страхования, с другой стороны, при возникновении банкротной ситуации, позволит страховой компании взять часть рисков на себя для возмещения долгов компании-банкрота. Отмечается, что с учетом очередности, в первую очередь, будут защищены интересы государства (в части налогов) и граждан (работников должника).
Необходимость введения обязательного страхования субъектов предпринимательства в РФ обосновывается проблемой неисполнения представителями бизнеса возложенных на них обязательств. В качестве практических результатов от реализации предлагаемой инициативы указываются:
ответственность государства перед бизнесом на деле, а не на бумаге;гарантия прав кредиторов;совершенствование законодательства в сфере банкротства.
Голосование за общественную инициативу продлится до 16 октября 2020 года.
