Законопроектом предлагается увязать возможность перехода права на недвижимость физического лица на основании заявления, поданного в электронной форме, с обязательным наличием предварительного уведомления собственником Росреестра о возможности такой формы подачи документов.

В данном случае планируется проставлять в ЕГРН специальную отметку о возможности отчуждения объекта на основании электронного заявления с использованием усиленной квалифицированной электронной подписи. Причем основанием для включения такой отметки в реестр будет служить заявление собственника недвижимости, поданное лично (или через законного представителя), либо посредством почтового отправления при условии, что подлинность подписи заявителя удостоверена в нотариальном порядке.
Необходимость внесения указанных поправок1 автор инициативы связывает с появлением новых мошеннических схем завладения чужой недвижимостью. Речь идет о незаконном использовании электронной подписи собственника для дистанционной подачи документов на госрегистрацию прав на недвижимость.
Парламентарий считает, что предлагаемые им изменения смогут обеспечить владельцам гарантии того, что без их ведома электронные документы о переходе прав не будут приняты к исполнению.
