Соответствующие разъяснения Банк России дал в своем информационном письме кредитным организациям, микрофинансовым организациям, кредитным потребительским кооперативам и сельскохозяйственным кредитным потребительским кооперативам. Об этом сегодня сообщается на официальном сайте регулятора.
Отмечается, что в адрес Банка России от потребителей-физлиц поступают жалобы на то, что некоторые кредиторы еще на этапе заключения договора потребительского кредита (займа) вносят в общие или индивидуальные условия пункты об изменении способов и частоты взаимодействия при взыскании задолженности. Другие же предлагают подписать об этом отдельное соглашение, но тоже в день заключения кредитного договора.
В связи с этим Банк России напоминает, что Федеральный закон от 21 декабря 2013 г. № 353-ФЗ «О потребительском кредите (займе)» предусматривает возможность заключения между кредитором и должником соглашения с отличными от общеустановленных частотой и способами взаимодействия сторон (в том числе при проведении переговоров о реструктуризации просроченной задолженности и по инициативе самого потребителя финансовой услуги). Но это не дает кредиторам права предлагать заемщику заключить соглашение об изменении способов и частоты взаимодействия при взыскании просроченной задолженности уже на этапе подписания договора потребительского кредита (займа).
