Председатель Правительства РФ Дмитрий Медведев подписал соответствующий документ. Он предусматривает разработку и принятие ряда нормативных актов, направленных на совершенствование правового регулирования госконтроля (надзора) с учетом риск-ориентированного подхода.
В частности, к 2021 году планируется принять федеральные законы:
«О государственном контроле (надзоре) и муниципальном контроле в Российской Федерации» (внесение проекта этого закона в Госдуму намечено на сентябрь текущего года); «Об обязательных требованиях» (его проект будет направлен в нижнюю палату парламента в октябре).
Также согласно плану1 будут подготовлены законопроекты, устанавливающие обязательные требования в отдельных сферах или вносящие изменения в действующее законодательство в целях систематизации обязательных требований. Предполагается, что последние поступят на рассмотрение к парламентариям в марте 2020 года. При этом в целях их реализации будет обновлена и база подзаконных нормативных правовых актов (постановлений Правительства РФ, ведомственных актов). А все ранее принятые нормативные правовые акты (включая акты кабинета министров, федеральных органов исполнительной власти и т. д.), касающиеся обязательных требований в соответствующей сфере регулирования, с 1 января 2021 года будут признаны утратившими силу или отменены.

Документом конкретизированы сроки и определены ответственные исполнители мероприятий плана (в их числе – Минэкономразвития и Минюст России, Экспертный совет и Аналитический центр при Правительстве РФ, общественные объединения предпринимателей, федеральные органы исполнительной власти).
Отметим, план мероприятий разработан по поручению Президента РФ Владимира Путина в рамках реализации Послания Президента РФ В.В. Путина Федеральному Собранию РФ от 20 февраля 2019 г. Напомним, глава государства, в частности, поручил кабинету министров проработать совместно с ведущими объединениями предпринимателей возможность внесения в законодательство поправок, касающихся отмены с 1 января 2021 года всех нормативных правовых актов, устанавливающих требования, соблюдение которых подлежит проверке при осуществлении госконтроля (надзора). Вместо них планируется ввести в действие новые нормы с актуализированными требованиями, разработанными с учетом риск-ориентированного подхода и современного уровня технологического развития в соответствующих сферах.
