Росгвардия представила для публичного обсуждения законопроект, которым планируется установить повышенные размеры административных штрафов за незаконное осуществление частной охранной деятельности. Так, граждан за совершение этого правонарушения предлагается штрафовать на сумму от 2,5 тыс. до 5 тыс. руб., должностных лиц – на сумму от 5 тыс. до 10 тыс. руб., юрлиц – в размере от 30 тыс. до 60 тыс. руб.
Отметим, что в настоящий момент за незаконное занятие частной охранной деятельностью для граждан установлена санкция в размере от 1,5 тыс. до 2,5 тыс. руб., для должностных лиц – на сумму от 2 тыс. до 3 тыс. руб., а для юрлиц – в размере от 20 тыс. до 30 тыс. руб. (ч. 1 ст. 20.16 КоАП РФ). При этом законопроектом планируется установить повышенную административную ответственность и за повторное совершение этого правонарушения:
для граждан – в виде штрафа от 5 тыс. до 10 тыс. руб. либо обязательных работ на срок от 100 до 200 часов; для должностных лиц – в виде дисквалификации на срок от шести месяцев до трех лет; для юрлиц – в виде штрафа от 65 тыс. до 100 тыс. руб. или административного приостановления деятельности на срок до 90 суток1.
Необходимость нововведения объясняется тем, что незаконная частная охранная деятельность на объектах различных форм собственности приводит к ослаблению их антитеррористической защищенности. Кроме того, отмечается в пояснительной записке к документу, она приводит к материальным потерям, как со стороны государственных организаций, так и со стороны граждан и юрлиц.
