В связи с принятием Указов Мэра Москвы от 1 октября 2020 г. № 96-УМ и от 6 октября 2020 г. № 97-УМ, регламентирующих положения об обязанности работодателей предоставлять личные данные работников, переведенных на дистанционную работу (не менее 30% от общей численности, всех работников из числа граждан старше 65 лет, а также граждан, имеющих хронические заболевания, за исключением работников, чье нахождение критически важно для работы организации) и не переведенных и оставшихся работать в офисах, Оперштаб Москвы в своем телеграм-канале разместил ответы на вопросы о деталях выполнения Указов Мэра.
В частности, отмечено, что обязанность по представлению сведений (номеров мобильных телефонов, личных автомобилей и транспортных, социальных карт) в отчетные таблицы распространяется не только на организации, но и на их работников. Поэтому Оперштаб напомнил, что в соответствии со ст. 189 Трудового кодекса работники обязаны соблюдать дисциплину труда, в том числе правила поведения, определенные федеральными законами.

Также подчеркивается, что требование о переводе не менее 30% работников на удаленный режим распространяется на все организации, в том числе на онлайн-магазины. Если же организация оказывает социальные услуги (например, общественный транспорт, вывоз ТБО и т. д.), соблюдение такого требования может быть обеспечено за счет персонала, осуществляющего «офисную» работу.
На вопрос о критериях определения сотрудников, пребывание которых на рабочем месте «критически важно» для деятельности организации, Оперштаб указал, что такими можно назвать сотрудников, отсутствие которых на рабочем месте создает угрозу жизни, здоровью граждан или ущерба имуществу, либо может привести к сбою в работе непрерывно действующих или опасных производств.
