Правительство РФ внесло в Госдуму законопроект, которым предлагается расширить содержащийся в п. 1 примечания к ст. 285 Уголовного кодекса перечень лиц, признаваемых должностными для целей гл. 30 УК РФ. Как отмечают авторы законопроекта1, согласно действующей редакции примечания к ст. 285 УК РФ лица, занимающие руководящие должности в дочерних организациях хозяйственных обществ, подконтрольных РФ, субъектам РФ или муниципальным образованиям, не являются субъектами таких преступлений, как злоупотребление должностными полномочиями, получение взятки, служебный подлог, халатность. При этом они наделены организационно-распорядительными и административно-хозяйственными функциями аналогично должностным лицам. «Уголовное преследование руководителей таких организаций за преступления против интересов службы в коммерческих и иных организациях (гл. 23 УК РФ) осложняется отсутствием заявлений об ущербе в правоохранительные органы со стороны потерпевших материнских структур, зачастую не заинтересованных в публичной огласке происшествий», – следует из пояснительной записки к законопроекту.

В этой связи должностными лицами в статьях гл. 30 УК РФ планируется признавать лиц, постоянно, временно или по специальному полномочию осуществляющих функции представителя власти либо выполняющих организационно-распорядительные, административно-хозяйственные функции в государственных органах, органах местного самоуправления, государственных и муниципальных учреждениях, государственных внебюджетных фондах, государственных корпорациях, государственных компаниях, публично-правовых компаниях, государственных и муниципальных унитарных предприятиях, хозяйственных обществах, в высшем органе управления которых РФ, субъект РФ, муниципальное образование имеют право прямо или косвенно (через подконтрольных им лиц) распоряжаться более чем 50% голосов либо в которых РФ, субъект РФ, муниципальное образование имеют право назначать (избирать) единоличный исполнительный орган и (или) более 50% состава коллегиального органа управления, в акционерных обществах, в отношении которых используется специальное право на участие РФ, субъектов РФ или муниципальных образований в управлении такими акционерными обществами («золотая акция»), а также в Вооруженных Силах РФ, других войсках и воинских формированиях РФ.
Кроме того, предполагается также корреспондирующее изменение примечания к ст. 201 УК РФ.
