Последний день оплаты имущественных налогов по направляемым физлицам налоговым уведомлениям истек 2 декабря. Если произвести платеж после этой даты, то будет начисляться пеня. Однако некоторые граждане столкнулись с тем, что пеня была начислена даже при своевременной оплате, хоть и в последний день.
За разъяснениями о порядке действий налогоплательщиков в такой ситуации мы обратились в справочную службу ФНС России. Там пояснили, что такое некорректное начисление возможно, однако сумма пеней будет аннулирована автоматически в течение десяти рабочих дней, т. е. не позднее 16 декабря.
Если же по истечение этого срока пеня по-прежнему останется, то следует направить обращение в свою налоговую инспекцию. Сделать это можно через «Личный кабинет налогоплательщика» в разделе «Жизненные ситуации». В обращении следует указать информацию о том, что налог был уплачен своевременно (2 декабря), но при этом начислена пеня в соответствующем размере. Для подтверждения этих сведений к обращению нужно приложить копию платежного поручения. После проверки налоговой инспекцией указанной информации и в случае отсутствия нарушений пеня будет аннулирована.
Напомним, что пеня может начисляться и в случае, если в платежном поручении были допущены ошибки, которые, тем не менее не повлекли за собой неперечисление средств в бюджет – например, неверно указан тип или основание платежа, налоговый период или счет Федерального казначейства. В этом случае налогоплательщику нужно подать заявление на уточнение платежа, приложив документы, подтверждающие уплату налога и его перечисление в бюджет (п. 7 ст. 45 Налогового кодекса). В этом случае, после рассмотрения заявления и проверки приложенных документов, налоговая инспекция выносит решение об уточнении платежа и пересчете суммы пени с момента фактической уплаты налога.
Если же ошибки в платежном поручении помешали перечислению суммы налога в бюджет, то платеж не засчитают и сумму пени не скорректируют. К таким ошибкам можно отнести, например, неверное указание наименования банка получателя.
