Состоявшееся вчера мероприятие было посвящено обсуждению актуальных вопросов регулирования рынка профессиональной юридической помощи, а также совершенствования адвокатской деятельности и развития адвокатуры. Об этом сообщается на официальных сайтах Правительства РФ и ФПА РФ.
Председатель Правительства РФ Дмитрий Медведев озвучил ряд проблем отрасли, а представители адвокатского сообщества высказали свои предложения по совершенствованию адвокатской деятельности и развитию адвокатуры. В частности, они указали на необходимость:
обеспечения достойной оплаты труда адвокатов, участвующих в гражданском и административном судопроизводстве по назначению суда (речь шла о выплате им вознаграждения в размерах не меньших, чем установленные для адвокатов, осуществляющих защиту по назначению в уголовном судопроизводстве);признания адвокатского удостоверения, выдаваемого Минюстом России, удостоверением личности в целях посещения юрисдикционных учреждений (судов, СИЗО, ФССП России и т. п.);предоставления адвокатам права пользоваться теми же налоговыми режимами, что и практикующим юристам без адвокатского статуса (в частности, УСН).
Премьер-министр предложил в ближайшее время завершить экспертное обсуждение проекта Концепции регулирования рынка профессиональной юридической помощи. Ожидается, что уже к началу марта документ поступит в кабинет министров. Также Дмитрий Медведев сообщил, что в настоящее время в рамках подготовки новой концепции КоАП обсуждается вопрос о целесообразности введения института «адвокат по назначению» при рассмотрении дел по отдельным составам административных правонарушений. Также он затронул проблему завышенного срока ответа на запрос адвоката.
После совещания президент ФПА РФ Юрий Пилипенко выразил надежду, «что эта встреча поможет справиться со многими адвокатскими проблемами, решение которых влияет на обеспечение права на получение квалифицированной юридической помощи, на защиту прав граждан».
