Минэкономразвития России подготовило проект формы соответствующего заявления, а также порядок его заполнения и подачи. Общественное обсуждение проекта ведомственного приказа, размещенного на федеральном портале нормативных правовых актов, продлится до 7 августа. Напомним, проектом федерального закона № 792949-7 предлагается внести изменения в Федеральный закон «О несостоятельности (банкротстве)» в части внесудебного банкротства гражданина. Законопроект принят нижней палатой парламента в третьем чтении и в настоящее время проходит процедуру одобрения в Совете Федерации. Вступление в силу поправок в случае принятия соответствующего закона предполагается с 1 сентября (в редакции текста законопроекта к третьему чтению).
Согласно проекту приказа1 форма заявления о признании гражданина банкротом во внесудебном порядке должна быть заполнена вручную либо в машинописном виде. Не допускается исправление ошибок, двусторонняя печать документа на бумажном носителе и скрепление листов документов.

При заполнении формы вручную должны использоваться чернила черного, фиолетового или синего цвета. Заполнить бланк можно как печатными, так и прописными символами. Если заявление заполняется в машинописном виде, печать знаков должна выполняться шрифтом Times New Roman высотой 10 – 12 пунктов.
Заполненный бланк заявления и копии приложенных к нему документов нужно будет подать по месту жительства гражданина или месту пребывания в многофункциональный центр предоставления государственных и муниципальных услуг.
Ввести в действие приказ Минэкономразвития России при его утверждении планируется с 1 сентября.
