Группа депутатов Госдумы во главе с Ильей Осиповым предложила установить административную ответственность за указанные деяния для должностных и юридических лиц. Так, первых планируется наказывать штрафом в размере от 4 тыс. до 5 тыс. руб., а юрлиц – в размере от 40 тыс. до 50 тыс. руб. В этих целях планируется внести изменения и дополнения в абз. 1 ч. 2 ст. 7.21 КоАП.
Необходимость установления административных штрафов за самовольные переустройство или перепланировку помещения в многоквартирном доме для указанных лиц1 объясняется подготовкой к третьему чтению законопроекта о введении соответствующего запрета. Речь идет о введении ограничений на перепланировку нежилых помещений в многоквартирных домах аналогично действующим для жилых. Документом, в частности, планируется распространить действующие правила по согласованию перепланировок и переобустройств жилых помещений на нежилые.
Разработчики инициативы отмечают, что размер санкций для юридических и должностных лиц за самовольное переустройство или перепланировку будет таким же, как и за нарушение правил содержания и ремонта жилых домов и жилых помещений (ст. 7.22 КоАП).
