Отражение налоговой инспекцией в справках о состоянии расчетов с бюджетом одновременно недоимки и переплаты по одному и тому же налогу в одинаковых размерах по состоянию на конкретную дату свидетельствует об отсутствия налоговой задолженности перед бюджетом. К таком выводу пришел Верховный Суд Российской Федерации в Определении от 29 ноября 2018 г. № 310-КГ18-7101, оставив в силе решение суда первой инстанции, а постановления апелляционного и кассационного судов ВС РФ отменил. ФНС России разослала это определение для использования территориальными налоговыми органами в работе письмом от 13 декабря 2018 г. № СА-4-7/24243 «О направлении информации».
В рассматриваемом деле налогоплательщик посчитал незаконным решение об отказе в продлении срока действия лицензии на осуществление розничной продажи алкогольной продукции. По мнению юрлица, ему пришлось дважды заплатить государственную пошлину в связи с неправомерными действиями лицензирующего органа. А именно, Минпромторг России отказался продлевать срок действия лицензии, так как в порядке межведомственного взаимодействия поступила информации о недоимке общества по УСН в размере 3 руб.

Напомним, что задолженность должна отсутствовать на дату поступления заявления о выдаче лицензии (подп. 3 п. 9 ст. 19 Федерального закона от 22 ноября 1995 г. № 171-ФЗ «О государственном регулировании производства и оборота этилового спирта, алкогольной и спиртосодержащей продукции и об ограничении потребления (распития) алкогольной продукции»).
Налоговое ведомство указало, что налогоплательщик может самостоятельно доказать отсутствие задолженности перед бюджетом. А именно, представить в лицензирующий орган дополнительную информацию, в том числе полученную от налоговых органов о состоянии расчетов с бюджетом.
