Депутат Олег Лебедев внес на рассмотрение Госдумы законопроект1, которым предлагает внести изменения в Закон РФ от 7 февраля 1992 года № 2300-1 «О защите прав потребителей» (далее – Закон № 2300-I) и в Федеральный закон от 28 декабря 2009 года № 381-ФЗ «Об основах государственного регулирования торговой деятельности в Российской Федерации»(далее – Закон № 381-ФЗ). Так, в п. 1 ст. 8 Закона № 2300-I планируется ввести норму о праве потребителя знать, помимо информации об изготовителе товара, продавце, режиме его работы и реализуемом товаре, еще и об исходной цене товара, которая не должна превышать среднюю за шесть месяцев, предшествующих дате начала распродажи, цену на данный товар в торговом объекте. Средняя цена товара будет рассчитываться по установленной уполномоченным федеральным органом исполнительной власти методике.
Закон № 381-ФЗ предусматривается дополнить положениями, раскрывающими понятия распродажи товаров, исходной и итоговой цен на товары, а также нормами, устанавливающими требования к проведению распродажи товаров. В частности, требования к распродаже товаров включают в себя обязанность продавца в наглядной и доступной форме довести до потребителей следующую информацию:
уникальное наименование и доступное для приобретения количество товара, в отношении которого проводится распродажа;точные сроки и причину проведения распродажи;исходную цену на товар, от которой исчисляется скидка.размер предоставляемой скидки (должен быть указан в виде фиксированной суммы и процента, на которые снижается исходная цена на товар);специальные условия предоставления скидки;итоговую цену на товар, по которой он может быть приобретен с учетом предоставленной скидки. Если итоговая цена на товар определяется несколькими специальными условиями предоставления скидки, до потребителя должна быть доведена каждая такая цена с соблюдением каждого специального условия.
Кроме того, предлагается ввести запрет на размещение в торговом объекте информации, вводящей потребителей в заблуждение о реализации товара по сниженным ценам.
В действующем российском законодательстве положения о скидках на товары упоминаются при раскрытии признаков недостоверной рекламы и, соответственно, регулируются Федеральным законом от 13 марта 2006 г. № 38-ФЗ «О рекламе». Однако вопросы введения потребителей в заблуждение путем манипулирования информацией о скидках на ценниках в торговом объекте законодательно не урегулированы. Автор законопроекта считает, что необходимость его принятия обусловлена предупреждением злоупотребления правом самостоятельного определения цен на продаваемые товары со стороны продавца, что позитивно отразится на развитии конкуренции, а также на финансовом благополучии потребителей.
