Группа депутатов Госдумы во главе с Игорем Лебедевым и член Совета Федерации Сергей Леонов внесли в нижнюю палату парламента законопроект о поправках в Трудовой кодекс.
Документом инициирована корректировка ч. 5 ст. 112 ТК РФ, предусматривающей возможность переноса выходных дней на другие дни в целях рационального использования работниками выходных и нерабочих праздничных дней. Это допускается по предписанию федерального закона или в соответствии с отдельным актом Правительства РФ.
Рассматриваемую норму предлагается1 дополнить указанием на то, что один из выходных дней соответствующего календарного года переносится нормативным правовым актом Правительства РФ на 31 декабря. Такой перенос предполагается в случае, если эта дата не выпадает на выходной день.
По действующему законодательству перечень нерабочих праздничных дней включает 14 дат, и 31 декабря не входит в их число. Однако, по мнению парламентариев, если этот день является рабочим, то работники нередко не выполняют трудовые функции в полном объеме, что обусловлено подготовкой к празднованию Нового года. «Лучше было бы решить этот вопрос однозначно и навсегда. День 31 декабря все равно нельзя назвать рабочим, потому что люди озабочены подготовкой к празднику и им трудно сосредоточиться конкретно на работе. Логичней было бы сделать этот день нерабочим на постоянной основе, но таким образом, чтобы соблюсти уже сложившийся в стране баланс рабочих и праздничных дней», – пояснил депутат Госдумы Дмитрий Савельев.
Ожидается, что перенос выходного дня на 31 декабря позволит работникам и работодателям более рационально использовать выходные и нерабочие праздничные дни, а также соблюсти баланс интересов между работниками, работодателями и профсоюзами. При этом уточняется, что общее количество нерабочих праздничных дней сохранится в том же объеме, что и сейчас.
Отметим, законопроекты о выходном дне 31 декабря практически каждый год поступают в Госдуму. Так, еще в 2014 году предлагалось дополнить этой датой перечень нерабочих праздничных дней, а в 2015 году – сократить продолжительность Новогодних каникул на три дня и включить в них 31 декабря. Тогда же представители Минтруда России высказывались против этой идеи. Они обосновывали свою позицию тем, что около 30% общей численности работников заняты обслуживанием населения и вынуждены работать вне зависимости от даты. Кроме того, указывалось, что бюджетный финансовый год заканчивается 31 декабря, следовательно, в этот день еще можно провести необходимые платежи. А поскольку работа в выходной и праздничный день оплачивается в двойном размере, то введение нового праздничного дня повлечет дополнительные издержки.
