Президент РФ Владимир Путин подписал Федеральный закон от 27 декабря 2019 г. № 463-ФЗ «О внесении изменений в статью 1 Федерального закона «О минимальном размере оплаты труда». Документом с 1 января 2020 года увеличен минимальный размер оплаты труда. Если сейчас он составляет 11 280 руб. в месяц, то со следующего года будет равен 12 130 руб. в месяц (на 850 руб. больше).

Кроме того, скорректирована1 норма, касающаяся установления МРОТ в размере величины прожиточного минимума трудоспособного населения в целом по РФ за II квартал предыдущего года. Так, теперь предусмотрено, что ежегодно устанавливаемый с 1 января МРОТ не обязательно должен равняться указанной величине, а может ее и превышать.
Напомним, МРОТ вводится организациями, финансируемыми из бюджетных источников, – за счет средств соответствующих бюджетов, внебюджетных средств, а также средств, полученных от предпринимательской и иной приносящей доход деятельности, а всеми остальными организациями – за счет собственных средств (ст. 2 Федерального закона от 19 июня 2000 г. № 82-ФЗ «О минимальном размере оплаты труда»). Он применяется для регулирования оплаты труда и определения размеров пособий по временной нетрудоспособности, по беременности и родам, а также для иных целей обязательного социального страхования. Применение МРОТ для других целей не допускается.
