Уполномоченный при Президенте РФ по защите прав предпринимателей Борис Титов на встрече с заместителем председателя Совета безопасности РФ Дмитрием Медведевым рассказал о предлагаемых мерах поддержки бизнеса в условиях ограничений, связанных с пандемией нового коронавируса, а также о предложениях по изменению уголовного и уголовно-процессуального законодательства.
В частности, предлагаются1 следующие виды мер поддержки предпринимателей:
освобождение от обязанности по уплате всех налогов (кроме НДС) и страховых взносов за 2020 год всех предприятий с годовым оборотом до 2 млрд. руб. (в 2019 году), а также социальных НКО, работающих в пострадавших отраслях, либо если их выручка снизилась более 30% за 1-3 кварталы 2020 г. по сравнению с аналогичным периодом 2019 года; смягчение условий программы выдачи льготных кредитов на возобновление деятельности по ставке не более 2%, предусмотрев полное списание задолженности по кредиту при сохранении по состоянию на 1 марта 2021 года – не менее 80 % штата по состоянию на 1 июня текущего года, а также списание задолженности по кредиту в размере 50% при сохранении числа работников по состоянию на 1 марта 2021 года – не менее 70 % штата по состоянию на 1 июня текущего года; введение на территории всей страны моратория на повышение кадастровой стоимости недвижимости в 2020 году (для целей налогообложения).

Помимо этого, в части совершенствования уголовного и уголовно-процессуального законодательства Уполномоченный полагает возможным расширить круг дел, рассматриваемых судом присяжных, включив в него дела о преступлениях, совершенных в сфере предпринимательской деятельности. В этой связи, по мнению бизнес-омбудсмена, следует предусмотреть в ст. 30 Уголовно-процессуального кодекса возможность ходатайствовать о рассмотрении дела судом с участием присяжных заседателей лицами, обвиняемыми по ч. 3, ч. 4, ч. 6, ч. 7 ст. 159, ч. 3-ч. 4 ст. 159.1-ст. 159.3, ч. 3-ч. 4 ст. 159.5-ст. 159.6, ч. 3-ч. 4 ст. 160 и ч. 2 ст. 201 Уголовного кодекса, если эти деяния совершены лицами из категорий, указанных в ч. 1.1. ст. 108 УПК РФ.
Также Уполномоченный считает важным четко регламентировать в ст. 106 УПК РФ порядок заявления ходатайства обвиняемым о применении залога в качестве меры пресечения. По мнению Бориса Титова, следователь, которому поступило ходатайство обвиняемого о залоге, должен в течение 3 дней вынести согласованное с руководителем следственного органа постановление о внесении ходатайства в суд с изложением своей позиции по вопросу необходимости его удовлетворения.
