ФНП рассказала, в каких случаях подлинность подписи на сделках может быть заверена
Нотариусы могут свидетельствовать подлинность подписи на документах, представляющих собой содержание сделки, лишь в ряде случаев, пояснила ФНП (письмо ФНП от 3 февраля 2017 г. № 324/03-16-3).

В частности, сообщается, что нотариус вправе подтвердить подлинность подписи на заявлении об отмене доверенности, если информация об этом в соответствии с законом подлежит опубликованию в официальном издании, в котором публикуются сведения о банкротстве. (абз. 3 п. 2 ст. 189 Гражданского кодекса).

Помимо этого указывается, что нотариус свидетельствует подпись наследника или наследников в случае пересылки по почте:

заявлений о принятии наследства или о выдаче свидетельства о праве на него (абз. 2 п. 1 ст. 1153 ГК РФ);

заявлений или отказе от наследства (п. 2 ст. 1159 ГК РФ);

документов о согласии на принятие наследником наследства по истечении срока, установленного для его принятия без обращения в суд (если такое согласие дается не в присутствии нотариуса) (п. 2 ст. 1155 ГК РФ).

Также поясняется, что нотариусы вправе заверить подпись на заявлении участника общества об отказе от использования преимущественного права покупки доли в уставном капитале организации (п. 6 ст. 21 Федерального закона от 08 февраля 1998 г. № 14-ФЗ «Об обществах с ограниченной ответственностью»).

Напомним, что по общему правилу нотариус не вправе подтверждать подлинность подписи на документах, являющихся содержанием сделки (ч. 2 ст. 80 Основ законодательства Российской Федерации о нотариате от 11 февраля 1993 г. № 4462-I; далее – закон о нотариате). Однако законодательство предусматривает ряд исключений, когда удостоверяющая подпись нотариуса обязательна. К примеру, если гражданин вследствие физического недостатка, болезни или неграмотности не может собственноручно подписаться, то по его просьбе сделку может подписать другой гражданин. При этом Подпись последнего должна быть засвидетельствована нотариусом либо другим должностным лицом, имеющим право совершать такое нотариальное действие (п. 3 ст. 160 ГК РФ).
