Сегодня, 26 мая, парламент одобрил в первом чтении законопроект №130151-7, предусматривающий возможность уплатить штраф за административное правонарушение в области таможенного дела в размере 50%, при условии, что штраф уплачивается в течение тридцати дней со дня вступления в силу соответствующего постановления.По мнению зампреда комитета Госдумы по безопасности и противодействию коррупции Анатолия Выборного, эта мера однозначно действенна и будет стимулировать нарушителей оплачивать штраф в срок.
«Практика правоприменения в сфере административных правонарушений таможенного законодательства на сегодня такова, что штрафы уплачиваются далеко не всеми и не всегда. Нарушители стремятся уйти от ответственности: либо вовсе не платят, либо сильно затягивают с уплатой штрафа, либо необоснованно обжалуют постановления в суде.
Согласно статистике, добровольно уплачиваются лишь 2/3 от всего объема штрафов, наложенных в связи с нарушением таможенного законодательства. Это приводит к тому, что, во-первых, бюджет недополучает большой объем средств. Во-вторых, огромная нагрузка ложится на должностных лиц таможенных органов, на судей и судебных приставов-исполнителей. Новая мера позволит снизить эту нагрузку и будет мотивировать нарушителей таможенного законодательства к уплате штрафов в срок», — прокомментировал парламентарий.
«Глубоко убежден, что ужесточение наказания не всегда является эффективной мерой воздействия на правонарушителей. Иногда послабления такого рода являются более эффективным механизмом. У нас уже есть яркий пример такой результативности. Например, аналогичная норма, касающаяся правонарушений в области дорожного движения, которая успешно работает более года. Согласно статистическим данным, за первые три недели 2016 года, после того, как соответствующий закон вступил в силу, было уплачено почти в 3,5 раза больше штрафов, чем в аналогичном периоде 2015 г. В контексте санкционных ограничений на ввоз продуктов из стран Европы, и, следовательно, большого количества нарушений этих ограничений, подобная мера будет весьма действенной, в том числе, в плане дисциплинирования правонарушителей», — сказал Анатолий Выборный.
