Соответствующий законопроект подготовило Минэкономразвития России и внесло на рассмотрение Правительства РФ, сообщается1 на сайте министерства. Законопроектом предусматривается, что при получении лицензии в заявлении на представление лицензии иностранные юрлица вместо данных из ЕГРЮЛ смогут указывать номер записи об аккредитации филиала иностранного юрлица в реестре, дату внесения записи об аккредитации филиала иностранного юрлица в реестр. Поправки планируется внести в Федеральный закон от 4 мая 2011 г. № 99-ФЗ «О лицензировании отдельных видов деятельности» (далее – Закон № 99-ФЗ). Документ подготовлен в рамках реализации плана мероприятий «Трансформация делового климата» по направлению «Защита прав и законных интересов субъектов предпринимательской деятельности».

Напомним, сегодня в заявлении о получении лицензии необходимо указать регистрационный номер записи о создании юрлица и данные документа, подтверждающего факт внесения сведений в ЕГРЮЛ (подп. 1 п. 1 ст. 13 Закона № 99-ФЗ), чего иностранные юрлица сделать не могут, так как перед началом осуществления деятельности на территории РФ их филиалы проходят аккредитацию, а не регистрацию в ЕГРЮЛ. Таким образом предполагается данный пробел в регулировании устранить.
В Минэкономразвития России сообщили, что по данным реестра аккредитованных филиалов иностранных юрлиц, размещенного на официальном сайте ФНС России, за период с 1 января 2015 года по 31 декабря 2019 года аккредитовано 2 257 филиалов иностранных юрлиц. Согласно статистике в России наиболее массовыми сферами, подлежащими лицензированию, являются образовательная, медицинская деятельность, перевозки пассажиров автомобильным транспортом и фармацевтическая деятельность.
