Правительством РФ принято решение о дополнении Положения о федеральном государственном надзоре в области защиты прав потребителей п. 6.1, которым установлено, что при осуществлении федерального государственного надзора в области защиты прав потребителей не проводятся плановые проверки в отношении изготовителей (исполнителей, продавцов, уполномоченных организаций или уполномоченных индивидуальных предпринимателей, импортеров, владельцев агрегаторов информации о товарах (услугах). Соответствующее постановление Правительства РФ от 4 сентября 2020 г. № 1351 вступит в силу 17 сентября.
Кроме того, федеральный государственный надзор в области защиты прав потребителей исключен из перечня видов федерального контроля, в отношении которых применяется риск-ориентированный подход. Такое изменение внесено в постановление Правительства РФ от 17 августа 2016 г. № 806.

Ранее Генеральная прокуратура РФ высказывалась относительно незаконности плановых проверок, проводимых Роспотребнадзором в области защиты прав потребителей. Также напомним, что в период с 1 апреля по 31 декабря 2020 года установлен запрет на проведение проверок в отношении субъектов МСП, за исключением проверок в связи с причинением или угрозой причинения вреда жизни и здоровью граждан, возникновением ЧС природного и техногенного характера.
