В настоящее время в Москве проходит IX Всероссийский съезд судей. Одной из тем для обсуждения стал порядок назначения судей на должности.
По словам Председателя Совета судей РФ Дмитрия Краснова, данный порядок необходимо либерализовать. Он заявил, что действующие нормы, в том числе процессуальное законодательство и ст. 9 Кодекса судейской этики, слишком строгие и препятствуют назначению многих специалистов.
С такой позицией согласился и Председатель Высшей квалификационной коллегии судей РФ Николай Тимошин. По его оценке, при буквальном толковании и формальном применении п. 4 ст. 9 Кодекса судейской этики невозможно назначение достойных кандидатов на должности судей.
Отметим, что в данном случае речь идет о норме, в соответствии с которой судья должен отказаться от рассмотрения дела, если есть предусмотренные законом основания для его отвода либо если может возникнуть конфликт интересов или ситуация, ставящая под сомнение беспристрастность судьи. В числе прочего это касается случаев, когда судья располагает сведениями, согласно которым он может стать свидетелем по существу данного спора. Имеются в виду и ситуации, когда судья или его супруг или супруга, либо близкий родственник одного из них имеет заинтересованность в рассматриваемом деле, может существенно повлиять на ход судебного производства, или работает в организации, являющейся участником процесса, или решение суда может существенно затрагивать их интересы (п. 4 ст. 9 Кодекса судейской этики).
Кстати, сравнительно недавно ст. 9 Кодекса судейской этики критиковали и адвокаты. По данным ФПА России, существует статистика, свидетельствующая о том, что в настоящее время либо адвокатам, у которых имеются родственники-судьи, приходится прекращать свой статус, либо кандидатов на должности судей не представляют к назначению, так как их родственники являются адвокатами.
