Такая санкция будет назначаться в случае, если судья ранее уже подвергался дисциплинарному взысканию (Федеральный закон от 29 июля 2018 г. № 243-ФЗ «О внесении изменений в Закон Российской Федерации «О статусе судей в Российской Федерации» и Федеральный закон «Об органах судейского сообщества в Российской Федерации»). Хотя первоначальной редакцией законопроекта предполагалось, что нововведение начнет действовать уже с 1 января 2019 года.
При этом судья будет считаться не привлекавшимся к дисциплинарной ответственности, если он не совершит нового дисциплинарного проступка в течение срока пребывания в квалификационном классе, присвоенном ему в результате применения взыскания.
