С 1 сентября следующего года за существенное нарушение Закона РФ от 26 июня 1992 г. № 3132-I «О статусе судей в Российской Федерации» и (или) Кодекса судейской этики судей смогут наказывать понижением в квалификационном классе. Такая санкция будет назначаться в случае, если судья ранее уже подвергался дисциплинарному взысканию (Федеральный закон от 29 июля 2018 г. № 243-ФЗ «О внесении изменений в Закон Российской Федерации «О статусе судей в Российской Федерации» и Федеральный закон «Об органах судейского сообщества в Российской Федерации»). Хотя первоначальной редакцией законопроекта предполагалось, что нововведение начнет действовать уже с 1 января 2019 года.
При этом судья будет считаться не привлекавшимся к дисциплинарной ответственности, если он не совершит нового дисциплинарного проступка в течение срока пребывания в квалификационном классе, присвоенном ему в результате применения взыскания.

Отметим, что установить понижение в квалификационном классе в качестве дисциплинарного взыскания предложил Президент РФ Владимир Путин на торжественном собрании, посвященном 95-летию Верховного Суда Российской Федерации в январе текущего года.
