С 3 января 2017 года вступит в силу приказ Минюста России, определяющий особенности направления адвокатского запроса (приказ Минюста России от 14 декабря 2016 г. № 288 «Об утверждении требований к форме, порядку оформления и направления адвокатского запроса»1). Установлено, что такой запрос адвокат может оформить как на бумажном носителе, так и в электронной форме. Причем возможны три способа выполнения запроса на бумаге: от руки, машинописным способом или в качестве распечатки на принтере. А электронный запрос должен отвечать требованиям, предъявляемым к электронному документообороту с использованием квалифицированной электронной подписи.
Определен закрытый перечень сведений, которые адвокат обязан включить в запрос. В частности, это наименование органа, куда документ направляется, данные адвоката, реквизиты соглашения об оказании юридической помощи, ордера, либо доверенности, указание нормы закона, в соответствии с которой запрос направляется, а также пояснение о запрашиваемых сведениях и другая информация.

Закреплено, что адвокат вправе прикладывать к запросу любые документы или их заверенные копии. Напомним, для того, чтобы документ был принят именно в таком виде, Минюст России на стадии разработки вносил в него правки. Изначально предполагалось, что к адвокатскому запросу должны быть приложены копии удостоверения адвоката и копии ордера или доверенности.
Ряд положений приказа Минюста России касается порядка направления адвокатского запроса. Так,запрос на бумажном носителе можно отослать по почте, по факсу, а также доставить лично или через представителя.
Электронный запрос адвокат может направить непосредственно в органы, общественные объединения и иные организации, но только при наличии у них организационной и технической возможности для рассмотрения запроса в электронной форме. Установлено, что адвокатский запрос регистрируется в специальном журнале, который должно вести адвокатское образование.
Напомним, с июня текущего года за отказ в ответе на адвокатский запрос могут наказать. Тогда же был установлен срок для ответа на такой запрос – 30 дней со дня его получения. Уже зафиксировано несколько случаев, когда граждане несли наказание за игнорирование адвокатского запроса. Административные штрафы были назначены директору автосервиса в Самарской области – в сентябре текущего года и главврачу психоневрологической больницы в Челябинске – в декабре (о чем сообщала ФПА России).
