Соответствующее поручение Президент РФ дал по итогам состоявшейся 17 декабря прошлого года пресс-конференции. Представить свои предложения по вопросу индексации пенсий работающих пенсионеров Правительство РФ должно до 1 февраля 2021 года.
Напомним, с 4 июля 2020 года в Конституции Российской Федерации действует новая норма, которая, помимо формирования в России системы пенсионного обеспечения граждан на основе принципов всеобщности, справедливости и солидарности поколений и поддержания ее эффективного функционирования, предусматривает осуществление индексации пенсий не реже одного раза в год в установленном федеральным законом порядке (ч. 6 ст. 75 Конституции РФ). Причем в норме не уточнены ни виды пенсий (по старости, за выслугу лет и т. п.), ни категории их получателей (например, работающие или неработающие пенсионеры).
Индексация пенсий работающих пенсионеров прекратилась с введением в Федеральный закон от 28 декабря 2013 г. № 400-ФЗ «О страховых пенсиях» ст. 26.1, предусматривающей выплату пенсионерам, осуществляющим работу или иную деятельность, в период которой они подлежат обязательному пенсионному страхованию, суммы страховой пенсии и фиксированной выплаты к ней без учета индексации (увеличения) размера фиксированной выплаты и корректировки размера страховой пенсии, имеющих место в период осуществления работы или иной деятельности. Такое положение действует с 1 января 2016 года.

В ходе пресс-конференции глава государства, отвечая на вопрос о возможном возобновлении индексации пенсий работающим пенсионерам, отметил, что главным условием такого возобновления является бюджетная обеспеченность. «Мы об этом думаем, конечно, и пенсионеры этого заслужили, это точно», – заключил Владимир Путин. А на встрече с руководителем ФНПР Михаилом Шмаковым 29 декабря он подчеркнул, что вопрос индексации требует дополнительного рассмотрения, так как «там есть элементы несправедливости».
Кроме того, кабмин совместно с органами исполнительной власти субъектов РФ должен принять дополнительные меры по повышению уровня информированности граждан о полагающихся соцвыплатах, а также осуществлять мониторинг оказания им установленных мер поддержки. Первый доклад о выполнении этого президентского поручения будет представлен до 20 января текущего года, далее – ежеквартально.
Также в числе поручений:
рассмотрение Правительством РФ при участии органов исполнительной власти субъектов РФ вопросов, касающихся проведения капремонта и строительства общежитий для студентов профессиональных образовательных организаций;рассмотрение вопросов о выдаче сертификатов лицам, прошедшим вакцинацию для профилактики новой коронавирусной инфекции с использованием российских вакцин, а также о международном признании этих сертификатов в целях осуществления гражданами выезда из РФ, въезда в Россию и пересечения ими государственных границ иностранных государств.
Общероссийскому общественному движению «Народный фронт «За Россию» рекомендовано до 30 января проанализировать обращения граждан, поступившие в рамках пресс-конференции Президента РФ. Информация по результатам такого анализа будет направлена в Администрацию Президента РФ, Правительство РФ, заинтересованные федеральные и региональные органы исполнительной власти для принятия соответствующих решений.
