Налоговая служба заявила о продлении приостановления применения мер взыскания задолженности до 1 июля 2020 года (письмо ФНС России от 26 мая 2020 г. № ЕД-20-8/71@). Также приостанавливается применение соответствующих обеспечительных мер, установленных налоговым законодательством. Такая мера поддержки бизнеса распространяется на всех налогоплательщиков – и юрлиц и предпринимателей, в том числе и тех, сведения о которых внесены в единый реестр субъектов малого и среднего предпринимательства, а также осуществляющих деятельность в сферах, наиболее пострадавших в условиях ухудшения ситуации в связи с распространением новой коронавирусной инфекции.
Как поясняет ФНС России, исключение будут составлять только те случаи, когда будет установлено, что непринятие мер взыскания задолженности может повлечь сокрытие активов и (или) возможность совершения иных действий, препятствующих взысканию, а также в отношении лиц, заявивших отказ от применения в отношении них моратория на возбуждение дел о банкротстве в соответствии (ст. 9.1 Федерального закона от 26 октября 2002 г. № 127-ФЗ). При этом, применение мер взыскания и соответствующих обеспечительных мер может быть осуществлено только по согласованию с руководителем вышестоящего налогового органа.

Напомним, ранее приостановление взыскания налоговой задолженности было установлено до 31 мая 2020 года включительно (письмо ФНС России от 27 апреля 2020 г. № ЕД-20-8/53@).
