Депутаты Госдумы Федот Тумусов и Александр Терентьев предложили для рассмотрения законопроект1, который определяет правовое положение медицинских работников госсектора. Если инициатива будет одобрена, отдельная норма о статусе медиков появится в Федеральном законе от 21 ноября 2011 г. № 323-ФЗ «Об основах охраны здоровья граждан в Российской Федерации» (далее – Закон № 323-ФЗ).
Предусмотрено, что статус медицинских работников приравнивается к статусу профессиональных категорий граждан, в отношении которых предусмотрен особый порядок государственной защиты их прав, свобод, здоровья и жизни (военнослужащие, сотрудники и служащие органов МВД России, Государственной противопожарной службы, ФСИН России, Росгвардии и ФССП).
Это правило будет использоваться в части ужесточения наказания за нападение на медиков.

Кроме того, устанавливается обязательное государственное страхование жизни и здоровья медработников, а также их профессиональной ответственности. Сегодня жизнь и здоровье медиков в обязательном порядке не страхуют, а страхование ответственности предусмотрено – но только на добровольных началах и без участия государства (ч. 1 ст. 72 Закона № 323-ФЗ).
Авторы поправок также предлагают предоставить медицинским работникам бесплатную правовую поддержку, в том числе круглосуточное предоставление специализированного юриста, адвоката по линии Минздрава России и региональных органов здравоохранения.
Федот Тумусов и Александр Терентьев внесли в Госдуму и еще один законопроект2, в очередной раз предложив ввести уголовную ответственность за причинение вреда жизни и здоровью медиков.
Свои инициативы депутаты объясняют тем, что проблема обеспечения безопасности медицинских работников в настоящее время стала принимать чрезвычайные масштабы. Они подчеркивают, что буквально в каждом регионе нашей страны с пугающей регулярностью происходят неприятные инциденты, связанные с нападением на сотрудников скорой помощи, врачей поликлиник и стационаров. А многие врачи, чувствуя свою незащищенность, со временем уходят из системы здравоохранения.
Депутаты надеются, что изменения позволят бороться с этими явлениями. А бесплатная юридическая помощь поможет медикам отстоять свои права при проведении проверок и следственных действий в связи с обвинениями в совершении профессиональных ошибок и правонарушений.
