Пленум Верховного Суда Российской Федерации принял постановление от 10 декабря (текст имеется в распоряжении портала ГАРАНТ.РУ), которым инициировал изменения в Уголовно-процессуальный кодекс. В частности, планируется установить двухмесячный срок для кассационного обжалования вступившего в законную силу приговора или иного итогового решения по уголовному делу. Как известно, сейчас ограничения срока кассационного обжалования уголовно-процессуальный закон не содержит. В этой связи предусматриваются поправки, обязывающие апелляционную инстанцию указывать в резолютивной части решений о порядке и сроке их кассационного обжалования. Также в целях недопущения нарушения такого срока планируется ввести норму о незамедлительном направлении копий апелляционного решения (приговора, определения, постановления) в суд первой инстанции для вручения (в течение трех суток со дня поступления из апелляционного суда) осужденному, оправданному, защитнику и обвинителю.
Наряду с установлением двухмесячного срока для принесения кассационной жалобы (представления) предлагается ввести норму о возможности его восстановления при наличии уважительной причины его пропуска путем подачи ходатайства в суд первой инстанции, постановивший приговор, который должен его рассмотреть. При этом оговаривается, что кассационное обжалование судебного акта, даже если срок пропущен или судом первой инстанции отказано в его восстановлении, будет возможно и путем подачи жалобы (представления) непосредственно в суд кассационной инстанции. В этом случае она будет рассмотрена в соответствии со ст. 401.10-401.12 УПК РФ, то есть не исключено, что и в порядке выборочной кассации, когда судья единолично отказывает в пересмотре, не установив оснований для передачи дела в судебном заседании судом кассационной инстанции.
Учитывая, что кассационные суды общей юрисдикции согласно Федеральному конституционному закону от 29 июля 2018 г. № 1-ФКЗ начали свою деятельность с 1 октября этого года, законопроект предусматривает целесообразность предоставления тем гражданам, которые еще не обжаловали судебные решения, вступившие в законную силу в период с 1 октября 2019 года, такого права в течение двух месяцев с момента введения в действие нового порядка кассационного обжалования.
