Изменения, внесенные в Федеральный закон от 3 июля 2019 года № 157-ФЗ «О мерах государственной поддержки семей, имеющих детей, в части погашения обязательств по ипотечным жилищным кредитам (займам) и о внесении изменений в статью 13.2 Федерального закона «Об актах гражданского состояния» (далее – Закон № 157-ФЗ), расширили меры господдержки многодетных семей в рамках ипотечных обязательств.
Так, многодетные семьи могут получить полное или частичное погашение обязательств по жилищным кредитам (займам) не только на покупку готовых объектов недвижимости, как это было установлено ранее, но и на:
недостроенные объекты ИЖС;строительство нового объекта ИЖС;долю в праве общей собственности;оплату паевого взноса члена ЖСК;жилого помещения в рамках программы на территории субъектов РФ;страхование имущества и(или) заемщика по ипотечному кредиту.
Это установлено ч. 5 ст. 1 Закон № 157-ФЗ.
Изменениями внесена новая ч. 5.2 в ст. 1 Закона № 157-ФЗ, содержащая исчерпывающий перечень организаций, которые могут быть кредиторами для указанных лиц, к ним относятся:
кредитная организация;единый институт развития в жилищной сфере;организация, включенная в перечень уполномоченных осуществлять деятельность по предоставлению ипотечных займов;ипотечный агент;учреждение, созданное по решению Правительства РФ для обеспечения функционирования накопительно-ипотечной системы жилищного обеспечения военнослужащих.
Кроме того, на полное или частичное погашение ипотечных обязательств могут рассчитывать граждане-поручители по кредитным договорам (займам), если они не являются заемщиками, но имеют на праве собственности или долю в праве на объект недвижимости и договор поручительства заключен до вступления новой редакции Закона № 157-ФЗ.
Закон № 157-ФЗ с изменениями вступил в силу 30 апреля.
