Соответствующий закон подписал Президент РФ Владимир Путин (Федеральный закон от 24 марта 2021 г. № 54-ФЗ). Статья 14.8 КоАП дополнена частью 6, в которой устанавливается административная ответственность за реализацию отдельных видов технически сложных товаров с предварительно установленными программами с нарушением установленного законодательством о защите прав потребителей требования об обеспечении возможности использовать отдельные виды технически сложных товаров с предустановленными программами, странами происхождения которых являются Россия и иные страны ЕАЭС.
Штрафы за совершение данного правонарушения составят для должностных лиц от 30 тыс. до 50 тыс., а для юрлиц – от 50 тыс. до 200 тыс. руб. Федеральный закон вступит в силу с 1 июля.

Напомним, в законодательство о защите прав потребителей внесены положения о необходимости обеспечения при продаже отдельных видов технически сложных товаров предварительной установки на таких устройствах программ, произведенных в России и других странах-членах ЕАЭС, для электронных вычислительных машин (Федеральный закон от 2 декабря 2019 г. № 425-ФЗ и Федеральный закон от 22 декабря 2020 г. № 460-ФЗ).
В начале года Правительство РФ определило перечень российских программ, которые подлежат предустановке на смартфоны, планшеты, компьютеры и цифровые телевизоры. Соответствующее распоряжение Правительства РФ от 31 декабря 2020 г. № 3704-р вступит в силу с 1 апреля.
Отметим также, что Минцифры России разъяснило, что предустановка необходимого софта будет доступна на электронных устройствах, произведенных после 1 апреля текущего года.
