Правительство РФ утвердило правила определения таможенной стоимости товаров, вывозимых из Российской Федерации (постановление Правительства РФ от 16 декабря 2019 г. № 1694). Новый порядок вступит в силу с 23 января 2020 года.
В документе прописаны основные принципы и методы определения таможенной стоимости товаров.
Так, например, устанавливается, что если невозможно определить таможенную стоимость вывозимых товаров методом по стоимости сделки с вывозимыми товарами, таможенная стоимость определяется с использованием метода по стоимости сделки с идентичными товарами. Для сравнения используются идентичные товары, вывезенные из России в такую же страну, в тот же или в соответствующий ему период времени, но не ранее чем за 90 календарных дней до вывоза определяемых товаров. Также, в качестве альтернативы может применяться метод по стоимости сделки с однородными товарами.
Если последние два метода применить не получится, то в качестве основы определения таможенной стоимости вывозимых товаров используется расчетная стоимость вывозимых товаров по методу сложения. Для этого складываются суммы расходов на изготовление или приобретение сырья и материалов, расходов на производство, а также на иные операции, связанные с производством вывозимых товаров и суммы прибыли и коммерческих и управленческих расходов, эквивалентной той величине, которая обычно учитывается при аналогичных продажах.
Для самых безнадежных вариантов предусмотрен резервный метод. Он подразумевает под собой гибкое применение всех вышеперечисленных методов соследующими допущениями:
при определении таможенной стоимости вывозимых товаров допускается разумное отклонение от установленных требований о том, что идентичные или однородные товары должны быть вывезены в тот же или в соответствующий ему период времени, что и вывозимые товары, но не ранее чем за 90 календарных дней до вывоза из РФ вывозимых товаров;при определении таможенной стоимости вывозимых товаров в качестве основы может быть использована ранее принятая таможенным органом таможенная стоимость товаров, определенная по методу сложения.
