Соответствующий закон подписан Президентом РФ Владимиром Путиным 24 марта (Федеральный закон от 24 марта 2021 г. № 48-ФЗ «О внесении изменений в Федеральный закон «Об основах туристской деятельности в Российской Федерации»). Согласно принятому закону реестр турагентов – это федеральный информационный ресурс, который будет содержать сведения о турагентах и субагентах. Вести его будет уполномоченный федеральный орган электронно на своем сайте во взаимодействии с иными федеральными системами, а также с системами туроператоров и турагентов.
Законом прописывается состав сведений, подлежащих включению в реестр турагентов, в том числе которые будут сформированы в реестре автоматически на основании сведений из ЕГРЮЛ и ЕГРИП, после внесения туроператором номера госрегистрации юрлица или ИП. Туроператор также должен будет самостоятельно не позднее чем через три рабочих дня со дня заключения договора с турагентом на продвижение и реализацию турпродукта (а также с указанием возможности или невозможности субагентства) сформировать в реестре турагентов данные о таком договоре. Внесение сведений туроператором будет осуществляться с использованием личного кабинета на официальном сайте уполномоченного федерального органа.
Основанием для отказа во внесении в единый реестр турагентов сведений является отсутствие таких сведений или их несоответствие сведениям, содержащимся в ЕГРЮЛ или ЕГРИП, либо наличие в указанных реестрах записи о прекращении деятельности турагентом.
Отмечено, что исключение сведений о турагенте, субагенте из единого реестра турагентов или прекращение их деятельности не освобождает туроператора от обязанности обеспечить оказание приобретенных туристом услуг.
Прописывается обязательность осуществления турагентской деятельности в соответствии с внесенными данными об этом в реестр турагентов, в том числе о продвижении и реализации туристского продукта и заключении договоров о субагентстве. В противном случае осуществление турагентской деятельности лицом, сведения о котором отсутствуют в реестре турагентов (турагентом или субагентом), повлечет за собой административную ответственность.
Федеральный закон вступит в силу с 1 января 2022 года. Сведения о турагентах должны быть внесены в единый реестр в течение 180 дней с указанной даты.

Закон об административной ответственности за нарушение законодательства о туристической деятельности в части ведения единого реестра турагентов Госдума приняла1 в третьем чтении 24 марта. Дополнения внесены в ст. 14.51 КоАП. В настоящий момент документ проходит процедуру одобрения в Совете Федерации.
Размеры штрафов за названные правонарушения в это сфере составят для граждан от 5 тыс. до 15 тыс. руб., должностных лиц – от 10 тыс. до 30 тыс. руб., юрлиц – от 50 тыс. до 100 тыс. При этом дела о правонарушении, совершенном туроператором, выразившемся в невнесении сведений о своем турагенте в единый реестр турагентов или с нарушением порядка их внесения, подлежат рассмотрению судьями. Дела о правонарушениях турагентов, субагентов будут рассматривать органы Роспотребнадзора. Вступление в силу закона о штрафах за нарушение законодательства о ведении реестра турагентов ожидается с 1 июля будущего года.
