Минэкономразвития России разработало проект Постановления Правительства РФ о проведении с 10 июля 2020 года по 30 июня 2021 года эксперимента, направленного на апробирование и внедрение в деятельность контрольно-надзорных органов единой информационной системы досудебного обжалования решений органов государственного контроля (надзора). Документом1 устанавливается процедура досудебного обжалования для максимального удобства всех участников контрольно-надзорной деятельности с учетом максимальной автоматизации данной процедуры. В качестве госорганов – участников эксперимента, которые будут уполномочены на рассмотрение жалоб, предлагается определить МЧС России, Ростехнадзор и Росздравнадзор.
Согласно проекту постановления правом на обжалование решений (действий) контрольного органа будут обладать контролируемые лица – юрлицо либо ИП, либо гражданин, не осуществляющий предпринимательскую деятельность, в отношении которых контрольным органом было принято юридически значимое решение, если при этом, по их мнению, были нарушены их права и законные интересы.
В рамках эксперимента контролируемое лицо будет вправе обжаловать:
решения контрольного (надзорного) органа о назначении плановой, внеплановой проверки; предписания об устранении выявленных нарушений, выданных контролируемому лицу; меры по недопущению причинения вреда или прекращению его причинения, принятые в соответствии с ч. 2 ст. 17 Федерального закона от 26 декабря 2008 г. № 294-ФЗ «О защите прав юридических лиц и индивидуальных предпринимателей при осуществлении государственного контроля (надзора) и муниципального контроля» (далее – Закон № 294-ФЗ).
При этом жалоба должна содержать наименование контрольного (надзорного) органа, Ф.И.О. должностного лица, решение и действия (бездействие) которых обжалуются, Ф.И.О. либо наименование заявителя (его представителя), его местонахождение, желаемый способ получения решения по жалобе. Также в жалобе подлежат указанию сведения об обжалуемых решениях (действиях) должностных лиц контрольного органа, которые привели или могут привести к нарушению прав заявителя, доводы, по которым он не согласен с такими решениями или действиями, и требования заявителя.

Жалоба гражданина (ИП) должна быть подписана простой электронной либо усиленной квалифицированной электронной подписью, жалоба юрлица – усиленной квалифицированной электронной подписью. В жалобе может содержаться ходатайство о приостановлении исполнения обжалуемого решения контрольного (надзорного) органа. Орган, уполномоченный на рассмотрение жалобы, в срок не позднее двух рабочих дней со дня регистрации жалобы должен принять решение о приостановлении исполнения обжалуемого решения контрольного (надзорного) органа или об отказе в таком приостановлении.
По итогам рассмотрения жалобы уполномоченный орган должен будет:
оставить жалобу без удовлетворения; отменить решение контрольного (надзорного) органа полностью или частично; отменить решение контрольного (надзорного) органа полностью или частично и принять новое решение.
Необходимость разработки указанного постановления обусловлена тем, что на сегодня порядок осуществления досудебного обжалования как самостоятельного института Законом № 294-ФЗ не установлен, как и основания для досудебного обжалования. Отмечается также, что контролирующие органы получат инструмент для анализа правоприменительной практики, кроме того, будут снижены издержки на судебные разбирательства.
Независимая антикоррупционная экспертиза проекта постановления завершится 9 июля.
