Налоговая служба рассказала об измененном порядке представления декларации по форме 3-НДФЛ. Так, при продаже некоторых категорий имущества налогоплательщики – физлица могут не представлять в налоговую инспекцию отчетность (Федеральный закон от 2 июля 2021 г. № 305-ФЗ). Нововведения будут распространяться на лиц, продавших имущество, начиная с налогового периода 2021 года.
Речь идет о продаже имущества (жилых домов, квартир, комнат, садовых домов или земельных участков) на сумму до 1 млн руб., а иного имущества (транспорта, гаражей и прочее) – до 250 тыс. руб. Поскольку указанные суммы соответствуют размеру имущественных налоговых вычетов, которые граждане могут получить (подп. 1 п. 2 ст. 220 Налогового кодекса), то при продаже имущества на эту сумму или меньше, налог к уплате будет равен нулю.

Как поясняет ФНС России, если же доходы от продажи объектов превышают размер вычетов, обязанность по предоставлению в инспекцию декларации по форме 3-НДФЛ сохраняется. При этом в отчетности можно не указывать сумму всех полученных в налоговом периоде доходов от продажи вышеуказанного недорого недвижимого имущества.
