Федеральные органы исполнительной власти, осуществляющие функции по нормативно-правовому регулированию в сферах госконтроля (надзора), на период реализации механизма «регуляторной гильотины» не должны допускать установления новых требований, соблюдение которых подлежит проверке при осуществлении госконтроля (надзора). Соответствующее поручение сегодня дал Председатель Правительства РФ Дмитрий Медведев. Об этом сообщается на официальном сайте кабинета министров.
Контроль за исполнением указанного поручения будут осуществлять Минюст и Минэкономразвития России при проведении правовой и антикоррупционной экспертиз проектов нормативных правовых актов, оценке их регулирующего воздействия и госрегистрации ведомственных актов.
Речь идет о таких требованиях, которые не соответствуют поручению Президента РФ Владимира Путина. Напомним, это поручение связано с необходимостью совершенствования российского законодательства в целях отмены с 1 января 2021 года всех нормативных правовых актов, устанавливающих требования, соблюдение которых подлежит проверке при осуществлении госконтроля (надзора), и установления новых актуализированных требований с учетом рискориентированного подхода и современного уровня технологического развития в подконтрольных сферах.
Кроме того, премьер-министр поручил1 руководителю Аппарата Правительства РФ Константину Чуйченко составить список федеральных органов исполнительной власти, осуществляющих нормативно-правовое регулирование в сферах госконтроля (надзора) и выполняющих контрольно-надзорные функции (имеются в виду те органы, которые будут участвовать в реализации механизма «регуляторной гильотины»). Также должен быть подготовлен перечень видов федерального госконтроля (надзора), которых затронет механизм «регуляторной гильотины». Эти сведения необходимо представить для утверждения до 17 июня. А до 27 июня должны быть сформированы рабочие группы по реализации механизма «регуляторной гильотины».
В свою очередь, Минюст и Минэкономразвития России подумают над поправками в правительственные акты в части порядка подготовки и принятия нормативных правовых актов Правительства РФ и ведомственных документов, разрабатываемых в рамках реализации механизма «регуляторной гильотины». На их подготовку ведомствам отведен почти месяц (до 1 июля).
Отметим, ранее был утвержден план по реализации механизма «регуляторной гильотины».
