Ст. 217 Налогового кодекса не предусматривает освобождение от НДФЛ указанного дохода физлица (письмо ФНС России от 14 января 2019 г. № БС-4-11/228). В данном случае период вынужденного прогула длился с апреля 2017 года по июнь 2018 года. При этом суммы среднего заработка за этот период организация выплатила в сентябре 2018 года по решению суда в связи с незаконным увольнением сотрудника. ФНС указала, что эти суммы подлежат отражению в форме 6-НДФЛ за девять месяцев. При этом подавать уточненные расчеты по форме 6-НДФЛ за предыдущие периоды не нужно.
Кроме того, ФНС России указала, что в рассмотренной ситуации страховые взносы должны начисляться в общеустановленном порядке. В связи с восстановлением сотрудника на работе и выплате ему среднего заработка за период вынужденного прогула организации необходимо подать уточненные расчеты за соответствующие отчетные (расчетные) периоды 2017-2018 г.
Напомним, что если в резолютивной части судебного решения нет разделения на выплачиваемый физлицу доход и сумму налога, то НДФЛ не удерживается.
