Минтруд России представил для публичного обсуждения и независимой антикоррупционной экспертизы ряд законопроектов, направленных на внедрение в оборот электронных трудовых книжек с 1 января 2020 года. Так, первым из них планируется ввести понятие «сведения о трудовой деятельности работника». Под ними планируется понимать информацию, содержащуюся в информационной системе ПФР, о периодах его работы, включая сведения о (об):
приеме на работу; переводе на другую работу с указанием наименования должности (работы), специальности, профессии, квалификации (разряда, класса, категории, уровня квалификации); увольнении с указанием оснований прекращения трудового договора)1.
Предполагается, что эта информация будет включаться в указанную систему на основании сведений, представляемых работодателями в соответствии с российским законодательством об индивидуальном (персонифицированном) учете в системе ОПС.
Согласно документу при заключении трудового договора сотрудник будет предъявлять работодателю указанные сведения, заверенные надлежащим образом. Уточняется, что их можно будет получить на бумажном носителе – у работодателя по последнему месту работы, в МФЦ, в ПФР либо через Единый портал госуслуг – как в бумажном, так электронном виде.
При этом у работодателей может появиться обязанность выдавать работнику сведения о трудовой деятельности за период работы на бумажном носителе, заверенные надлежащим образом. В период работы они будут обязаны сделать это по заявлению в письменной форме или направленному на адрес электронной почты работодателя – не позднее трех рабочих дней со дня подачи этого заявления, а при увольнении – в день прекращения трудового договора.
В течение 2020 года работодателям необходимо будет:
подготовить, принять или изменить локальные акты с участием выборного органа первичной профсоюзной организации; при необходимости внести изменения в соглашения и коллективные договоры; обеспечить техническую готовность к передаче сведений о трудовой деятельности работников в электронном виде в информационную систему, начиная с 1 января 2020 года.
Также согласно документу они будут обязаны в письменной форме уведомлять работника о его праве подать заявление на ведение трудовой книжки на бумажном носителе до 1 января 2027 года. Указанное право может появиться у сотрудников с 1 января 2020 года. В случае, если работник не напишет это заявление, то с 1 января 2021 года работодатель будет вправе отдать ему трудовую книжку на хранение, и таким образом он освободится от ответственности за ее сохранность.
Однако отдельным работникам планируется предоставить право написать заявление о ведении их трудовой книжки на бумажном носителе и в период с 1 января 2021 года до 1 января 2027 года. В частности, речь идет о сотрудниках, заключающих трудовой договор впервые или изменивших место работы. Указанным законопроектом с 1 января 2027 года ведение трудовых книжек на бумажном носителе прекратится окончательно.
Другим законопроектом предлагается дополнить ст. 5.27 КоАП новой ч. 8 и наказывать предупреждением должностных лиц работодателя за неоднократное в течение года нарушение сроков предоставления сведений в информационную систему либо предоставление их в неполном объеме или в искаженном виде. Новая санкция может появиться с 1 января 2021 года2.
Публичное обсуждение и независимая антикоррупционная экспертиза законопроектов завершатся 26 ноября.
